Agreement to these terms

These Terms of Use (“Terms”) govern access to and use of ChicUp, a mobile application and service operated by Brito Labs LLC, a Florida limited liability company (“Brito Labs,” “ChicUp,” “we,” “us,” or “our”).

By accessing or using ChicUp, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use ChicUp.

Your use of the iOS application is also subject to Apple’s Standard Licensed Application End User License Agreement. If these Terms conflict with Apple’s required terms, Apple’s required terms control to the extent of that conflict.

Eligibility

You must be at least 13 years old to use ChicUp. If you are a minor where you live, you must have permission from a parent or legal guardian.

You may not use ChicUp if applicable law prohibits you from receiving the service.

Accounts

ChicUp uses Sign in with Apple. You are responsible for maintaining control of your Apple account and device and for activity occurring through your ChicUp account.

Provide accurate information and notify us if you believe your account has been compromised.

The ChicUp service

ChicUp allows users to:

• Build a digital wardrobe
• Upload outfit and clothing photographs
• Record style preferences
• Receive personalized styling suggestions
• Generate look previews
• Score and evaluate outfits
• Save wardrobe items, outfits, favorites, and generated looks
• Use weather-related styling context
• Share selected content through the iOS share sheet

Features may change as the service develops.

AI-generated output

ChicUp uses artificial intelligence to detect clothing, analyze outfits, generate previews, and provide styling suggestions.

AI-generated results may be incomplete, inaccurate, or unsuitable for a particular person, event, climate, garment, or context. Scores and recommendations express automated styling assessments and are provided for inspiration and informational purposes.

Users remain responsible for deciding what to wear, purchase, upload, save, or share.

User content and photo rights

You retain ownership of photographs, wardrobe information, and other content you submit to ChicUp.

You grant Brito Labs LLC a limited, non-exclusive license to host, store, reproduce, process, resize, analyze, modify, and transmit your content only as reasonably necessary to operate, secure, support, and improve the ChicUp service.

You represent that:

• You own the content you upload or have permission to use it
• Your uploads do not violate privacy, publicity, copyright, trademark, or other rights
• You will not upload illegal, exploitative, abusive, or harmful content
• You will not upload another person’s photograph without appropriate permission

ChicUp may remove content or restrict accounts when reasonably necessary to comply with law, protect users, or enforce these Terms.

No public social feed at launch

ChicUp has no social feed or other in-app social features in this release. Users cannot post publicly, view other users’ content, create public profiles, comment, vote, follow, or send messages, and ChicUp provides no other user-to-user interaction.

You may share an Outfit Score or another result outside ChicUp only when you choose to use the iOS share sheet. ChicUp does not publish or display that content to other users inside the app. Once content is shared to another service, that service’s terms and privacy policy apply.

Subscriptions

ChicUp offers auto-renewing subscriptions through Apple In-App Purchase.

Weekly subscription:

• $9.99 per week
• No free trial
• Automatically renews weekly unless canceled

Annual subscription:

• Three-day free trial for eligible first-time subscribers
• $75 per year after the trial
• Automatically renews annually at $75 unless canceled

Introductory-offer eligibility is determined by Apple and generally applies only once per Apple subscription group.

Prices may vary by country, currency, taxes, or Apple storefront. The price and terms displayed by Apple immediately before purchase control your transaction.

Payment and renewal

Payment is charged to your Apple ID through Apple.

Unless canceled, a subscription automatically renews for the same subscription period. Apple may charge the renewal within 24 hours before the current subscription period ends.

You can manage or cancel a subscription in:

iPhone Settings → Apple ID → Subscriptions → ChicUp

Cancellation takes effect at the end of the current paid period. Except where required by law or Apple policy, canceling does not provide a partial refund for unused time.

Deleting an account does not cancel a subscription

Deleting your ChicUp account does not cancel an active Apple subscription.

You must cancel the subscription separately through Apple. If you delete your account without canceling, Apple may continue billing the subscription.

Restore purchases

Eligible subscriptions may be restored through ChicUp using the Apple ID associated with the original purchase.

Refunds

Apple processes all payments and refund requests. Brito Labs LLC does not receive complete payment-card information and cannot directly issue App Store refunds.

Refund requests should be submitted through Apple at reportaproblem.apple.com.

Acceptable use

You may not:

• Use ChicUp for unlawful, fraudulent, abusive, or harmful activity
• Upload content you do not own or have permission to use
• Violate another person’s privacy, publicity, intellectual-property, or contractual rights
• Attempt to access another user’s account or private information
• Circumvent subscription, authentication, security, or access controls
• Reverse engineer, scrape, copy, resell, or exploit ChicUp except where applicable law expressly permits it
• Interfere with the service, servers, networks, or providers
• Introduce malicious software or automated abuse
• Use ChicUp or its output to train competing models or services without written permission
• Misrepresent AI-generated material as guaranteed professional advice

Intellectual property

ChicUp, including its software, interface, design, branding, text, graphics, and underlying technology, is owned by Brito Labs LLC or its licensors and is protected by applicable intellectual-property laws.

These Terms provide a limited, personal, revocable, non-exclusive, non-transferable right to use ChicUp according to these Terms. They do not transfer ownership of ChicUp or its intellectual property.

Third-party services

ChicUp relies on services provided by Apple, Google Firebase, RevenueCat, Anthropic, OpenAI, and remove.bg.

Third-party services may be governed by their own terms and policies. We are not responsible for third-party services outside our reasonable control.

Privacy

Our Privacy Policy explains how information is handled and is incorporated into these Terms by reference.

Availability and changes

We may update, modify, suspend, or discontinue features to maintain security, comply with law, improve the service, or respond to technical and business requirements.

We do not guarantee that ChicUp will always be available, uninterrupted, secure, or error-free.

Account suspension and termination

We may suspend or terminate access when we reasonably believe a user has violated these Terms, created security or legal risk, failed to pay applicable charges, or misused the service.

Users may stop using ChicUp and delete their account at any time. Account deletion does not cancel an Apple subscription.

Disclaimers

To the maximum extent permitted by law, ChicUp is provided “as is” and “as available.”

Brito Labs LLC disclaims warranties that may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

ChicUp provides styling suggestions and automated assessments. It does not provide medical, legal, financial, safety, or other regulated professional advice.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, Brito Labs LLC and its officers, members, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, loss of goodwill, or costs arising from use of or inability to use ChicUp.

Where liability cannot be excluded, our total liability arising from ChicUp will not exceed the greater of the amount the user paid to ChicUp during the twelve months before the event giving rise to the claim or one hundred U.S. dollars.

Some jurisdictions do not permit certain liability limitations, so these limitations may not apply fully to every user.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Brito Labs LLC from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful use of ChicUp, content you upload, or material violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where mandatory consumer-protection law in your location applies.

Any court proceeding permitted under these Terms will be brought in an appropriate state or federal court in Florida, unless applicable law gives you the right to bring it elsewhere.

Changes to these terms

We may update these Terms as ChicUp changes. We will update the effective date and provide additional notice where required.

Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

Severability

If a provision of these Terms is held unenforceable, the remaining provisions will continue in effect.

No waiver

Failure to enforce a provision is not a waiver of the right to enforce it later.

Entire agreement

These Terms, the Privacy Policy, and Apple’s applicable license terms constitute the agreement governing use of ChicUp.
